Favourable tax environment

Although the aforementioned aspects are very important, one of the most important factors influencing the attractiveness of the Grand Duchy is undoubtedly the Luxembourg tax benefits for companies.

<a href="https://easybiz.lu/en/blog/luxembourg-corporation-tax">Luxembourg corporate tax</a>, recently modified with a reduction of one percentage point, stands at 14% for companies with a tax base of less than 175,000 euros or 16% for those with a tax base of more than 200,000 euros. This added to the municipal tax on economic activities and the contribution to the employment fund results in a maximum aggregate tax rate of 23.87% in the city of Luxembourg in 2025.

Although the tax rate is attractive compared to other countries such as France, Belgium or Italy, it is quite close to the European average, which at first glance seems to contradict the claim of exceptional tax attractiveness. However, given the considerable number of possible tax optimisations and benefits in Luxembourg, the real rate can be considerably reduced. Moreover, although many of these optimisations are generally legal, tax benefits sometimes come from hidden arrangements.

According to this investigation, almost half of the commercial companies registered in the country are pure financial holdings with no less than 6,500 billion euros in assets. Behind ingenious plots and cascading subsidiaries, Le Monde managed to calculate that twenty-nine of the thirty-seven CAC 40 groups based in France are also present in Luxembourg through at least 166 subsidiaries. Some of these companies are Dassault, Michelin, Sanofi, Danone, LVMH, L'Oréal and Chanel. Although some of them correspond to real operations on Luxembourg soil, three-quarters of these subsidiaries essentially serve financial interests.

These subsidiaries, whose interest is purely financial, are mostly present in the Grand Duchy for reasons of tax optimisation. Although this practice is legal, provided that the rules and regulations are respected, the extent of its application in Luxembourg shows how many of the companies are only established in the country to evade the taxation to which they would be subject in their countries of origin if they had not resorted to Luxembourg subsidiaries with optimisations that, according to the authors of the investigation, can reduce the effective rate to 1% or 2%.

Financial secrecy

This index takes into account a country's financial secrecy laws and the scope of its financial services provided to residents of other countries.

Its corporate tax rates are competitive, ranging from 14% to 16%, with a maximum effective rate of 23.87% in 2025. Environnement fiscal favorable

Bien que les aspects susmentionnés soient très importants, l'un des facteurs les plus importants qui influencent l'attractivité du Grand-Duché est sans aucun doute les avantages fiscaux luxembourgeois pour les entreprises.

L'impôt sur les sociétés luxembourgeois, récemment modifié avec une réduction d'un point de pourcentage, s'élève à 14 % pour les entreprises dont l'assiette fiscale est inférieure à 175 000 euros ou à 16 % pour celles dont l'assiette fiscale est supérieure à 200 000 euros. Ces filiales, dont l'intérêt est purement financier, sont pour la plupart présentes au Grand-Duché pour des raisons d'optimisation fiscale. Bien que cette pratique soit légale, pour autant que les règles et réglementations soient respectées, l'ampleur de son application au Luxembourg montre combien de sociétés ne sont établies dans le pays que pour échapper à l'imposition à laquelle elles seraient soumises dans leur pays d'origine si elles n'avaient pas eu recours à des filiales luxembourgeoises avec des optimisations qui, selon les auteurs de l'enquête, peuvent réduire le taux effectif à 1 ou 2 %.

Confidentialité financière

Un autre facteur qui attire sans aucun doute de nombreuses entreprises est le niveau de confidentialité financière que le Luxembourg parvient à maintenir. Bien que le pays ait fait des progrès notables dans ses efforts pour lutter contre la fraude fiscale et améliorer la transparence, il a encore un long chemin à parcourir. Des changements politiques importants, tels que la suppression du secret bancaire et la participation à l'échange automatique d'informations, témoignent des mesures positives prises par le pays. General principles on working hours in Luxembourg

The Labor Code establishes a clear regulatory framework on working hours in Luxembourg with precise rules aimed at protecting the health and well-being of employees. However, although these regulations cover a large majority of people, not all workers are covered and certain categories are excluded. The scope of these regulations as well as the limits they impose on the duration of working time are detailed below.

Scope of the regulations

The rules on working time in Luxembourg apply to all employees, both in the public and private sector, as well as to persons working for the purpose of acquiring vocational training, provided they do not benefit from other more favorable legal or conventional provisions. However, the labor code expressly excludes the following categories:

These categories are not subject to the Luxembourg workweek rules, however, they may be regulated by collective bargaining agreements that establish a different framework or by sectoral regulations, as is the case with fluvial transport, which has more flexible rules adapted to the reality of the company and the sector.

Duration of work 

The labor code defines working hours as the time during which the worker is at the disposal of the employer, or employers if there are several, except for rest periods during which he is not at the disposal of his employer or employers.  

This working time can be freely fixed between the parties but must respect a maximum of 8 hours per day and 40 hours per week.

An exception is provided for by law, however, if the work is spread over 5 days or less, the working day may be set at 9 hours per day provided that the total hours worked do not exceed the full-time weekly working hours in force in the company.&nbsp;

For example, an employee hired for 40 hours a week can work 9 hours a day from Monday to Thursday and 4 hours on Friday mornings.

Overtime pay in Luxembourg

Luxembourg overtime laws provide that overtime worked hours must be compensated by paid time off and the rest period is one and a half hours for each hour of overtime worked. If, for reasons inherent to the organization of the company, it is not possible to compensate overtime by taking time off, or if the employee leaves the company before recovering the overtime worked, these hours must be paid at 140%.

Night work

Employers in Luxembourg, in addition to having to respect a duration for working hours and overtime, also have to respect certain regulations for night work, with night work being considered as work performed at the following times:

For an employee, these holidays may coincide with days on which he did not have to work according to his work schedule or fall on a Sunday. There may also be non-working days on which an employee may be required to work due to the particular conditions of the company. In all these cases, employees are entitled to compensation, but it differs from case to case.

The regulation of working hours in Luxembourg shows how over time, a balance has been found between the flexibility required by companies and the protection of workers' rights. The Labor Code establishes a clear structure on the maximum length of the working day as well as specific provisions on overtime, night work and work on public holidays. Certain sectors and categories of employees are subject to specific exceptions. For example, emergency services, healthcare, hospitality, and transportation may apply different working hour arrangements based on operational needs. Additionally, employees such as senior executives, family workers, and sales representatives who mainly work outside the company are excluded from standard working time regulations.

According to Luxembourg law, employees working more than six consecutive hours must receive a break of at least 30 minutes, which may be split. Daily rest between workdays must be at least 11 consecutive hours, and employees are entitled to a minimum weekly rest of 44 consecutive hours, typically including Sunday.

In Luxembourg, if an employee works on an official public holiday, they are entitled to triple pay for the hours worked: regular salary for the public holiday (as if not worked), regular pay for the hours actually worked, plus a 100% supplement on those hours.

Principes généraux relatifs aux heures de travail au Luxembourg

Le Code du travail établit un cadre réglementaire clair concernant les heures de travail au Luxembourg avec des règles précises visant à protéger la santé et le bien-être des salariés. Cependant, bien que ces réglementations couvrent une large majorité de personnes, tous les travailleurs ne sont pas concernés et certaines catégories sont exclues. La portée de ces réglementations ainsi que les limites qu’elles imposent à la durée des heures de travail sont détaillées ci-dessous.

Portée des réglementations

Les règles relatives aux heures de travail au Luxembourg s’appliquent à tous les salariés, tant du secteur public que du secteur privé, ainsi qu’aux personnes travaillant dans le but d’acquérir une formation professionnelle, à condition de ne pas bénéficier d’autres dispositions légales ou conventionnelles plus favorables. Toutefois, le code du travail exclut expressément les catégories suivantes :

Durée du travail

Le code du travail définit les heures de travail comme étant le temps pendant lequel le salarié est à la disposition de l’employeur, ou des employeurs s’il y en a plusieurs, à l’exception des périodes de repos durant lesquelles il n’est pas à la disposition de son ou de ses employeurs.  

Ces heures de travail peuvent être librement fixées entre les parties, mais doit respecter un maximum de 8 heures par jour et de 40 heures par semaine.

La loi prévoit cependant une exception : si le travail est réparti sur 5 jours ou moins, la journée de travail peut être fixée à 9 heures par jour à condition que le total des heures effectuées ne dépasse pas la durée hebdomadaire de travail à temps plein en vigueur dans l’entreprise.

Par exemple, un salarié engagé pour 40 heures par semaine peut travailler 9 heures par jour du lundi au jeudi et 4 heures le vendredi matin.

Rémunération des heures supplémentaires au Luxembourg

La législation luxembourgeoise sur les heures supplémentaires prévoit que les heures de travail effectuées en dehors de l’horaire normal doivent être compensées par un repos payé, le temps de repos étant d’une heure et demie pour chaque heure supplémentaire travaillée. Si, pour des raisons liées à l’organisation de l’entreprise, il n’est pas possible de compenser les heures supplémentaires par des congés, ou si le salarié quitte l’entreprise avant d’avoir récupéré les heures supplémentaires effectuées, ces heures doivent être rémunérées à hauteur de 140 %.
