Definition of a CDD contract and temporary employment

A fixed-term or temporary contract of employment (Contrat à Durée Déterminée in French, CDD) is an agreement of employment for a specific period of time and for temporary tasks.&nbsp;

Most of the rules that apply for a CDI (permanent employment contract) usually apply for a CDD as well, as the structure, content and trial period are most of the times the same.

The main reasons of a CDD contract might be:

Duration

The maximum duration of a CDD contract is 24 months. In case of seasonal employment though, this duration drops down to 10 months, including renewals, over a 12 month period of time.&nbsp;

Trial period

Even though the trial period for fixed-term contracts was initially the same as for permanent contracts, recent reforms established new rules specifically for fixed-term contracts. According to those, the maximum applicable duration may not exceed a quarter of the duration of the whole contract. 

That was basically established as, in some cases, when following the trial period of a permanent contract, the trial period of a fixed-term contract exceeded the duration of the whole contract, which made no sense. So the new law establishes new trial periods, specifically for fixed-term contracts, in order to be proportional to the duration of the contract.&nbsp;

Article L.122-11 (1) of the Luxembourgish Labor Code therefore mentions that the trial period, while it cannot be less than 2 weeks, it can also not exceed a quarter of the whole duration of the fixed-term contract.

Renewal

A temporary appointment contract can be renewed twice that total period, so it cannot exceed the 2 years, with only a few legal exceptions to this rule such as University researchers, people working in entertainment and secondary school teachers.

Termination

Since the contract has a definite end date, there is no need for notice unless it is before that date. It can also continue after expiry, providing that it is transformed into a permanent contract of employment if exceeding the 24 months. A fixed-term contract can also be terminated during notice period and also due to serious misconduct of any party. If the contract is terminated before its fixed expiry date, costs might be included for the party terminating the contract.&nbsp;

There are also some rare but still valid reasons for automatic termination, such as long-term sickness, change in the disability status of the employee, invalidity pension and of course the case of death, of either the employer or the employee.

Yes - one of the reasons employers are using CDD contracts is for seasonal employment, the only difference is that seasonal employment must be even more limited in duration, up to 10 months maximum during 12 months, including renewals, while another type of CDD contract, can be up to 24 months including renewals.

Employee not registered for social security, missed payments or repeatedly delaying payment, behavioral issues such as emotional or physical violence, sexual harassment and denying leave repeatedly and without cause. In those cases, the employee must write a letter of termination with immediate effect. It has to be in physical form, either as registered mail or hand delivered, getting a signed copy of the employer. The reasons are not necessary to be mentioned unless the employee plans on taking the case to court.

Un contrat à durée déterminée (CDD) est un contrat de travail conclu pour une période déterminée et pour des tâches temporaires.

La plupart des règles qui s'appliquent au CDI (contrat de travail à durée indéterminée) s'appliquent également au CDD, car la structure, le contenu et la période d'essai sont le plus souvent identiques.

Exigences nécessaires et conditions spécifiques d'un contrat CDD

Un objectif spécifique doit être mentionné, et même si un contrat permanent n'a pas besoin d'une date de fin, celle-ci doit figurer dans un contrat CDD.

S'il s'agit d'un contrat de remplacement ou de renouvellement, cela doit également être mentionné.

Les principales raisons d'un contrat CDD peuvent être les suivantes:

Durée du contrat

La durée maximale d'un contrat CDD est de 24 mois. En cas d'emploi saisonnier, cette durée est ramenée à 10 mois, renouvellements compris, sur une période de 12 mois.

Période d'essai

Même si la période d'essai pour les contrats à durée déterminée (CDD) était initialement la même que pour les contrats à durée indéterminée (CDI), les récentes réformes ont établi de nouvelles règles spécifiques aux CDD. Selon celles-ci, la durée maximale applicable ne peut pas dépasser un quart de la durée de l'ensemble du contrat.

Cela a été établi essentiellement parce que, dans certains cas, lorsque la période d'essai d'un CDI était suivie d'une période d'essai d'un CDD qui, à la fois, dépassait la durée de l'ensemble du contrat, et cela n'avait aucun sens. La nouvelle loi établit donc de nouvelles périodes d'essai, spécifiquement pour les CDD, afin qu'elles soient proportionnelles à la durée du contrat.

L'article L.122-11 (1) du Code du Travail Luxembourgeois mentionne donc que la période d'essai, bien qu'elle ne puisse être inférieure à deux semaines, ne peut pas non plus dépasser un quart de la durée totale du contrat à durée déterminée.

Renouvellement

Un contrat d'engagement temporaire peut être renouvelé deux fois pour la même durée, c'est-à-dire qu'il ne peut pas dépasser deux ans, sauf quelques exceptions légales à cette règle, comme les chercheurs universitaires, les personnes travaillant dans le secteur du spectacle et les professeurs de l'enseignement secondaire.

La fin du contrat

Le contrat ayant une date de fin définie, il n'est pas nécessaire de le notifier, à moins qu'il ne prenne fin avant cette date. Il peut également se poursuivre après son expiration, à condition qu'il soit transformé en contrat de travail à durée indéterminée s'il dépasse les 24 mois. Un contrat à durée déterminée peut également être résilié pendant la période de préavis ainsi qu'en cas de faute grave de l'une des parties. Si le contrat est résilié avant sa date d'expiration, des frais peuvent être imputés à la partie qui résilie le contrat.

Il existe également des motifs rares mais toujours valables de résiliation automatique, tels que la maladie de longue durée, la modification de l'état d'invalidité du salarié, la pension d'invalidité et, bien entendu, le décès de l'employeur ou du salarié.
