Everyone usually knows what paid vacation is, the 26 working days per year that accumulate as time worked piles up and to which employees are entitled as days off. However, what not everyone knows is that it is also possible to request leave for other reasons, such as force majeure or extraordinary personal circumstances, including a wedding or the death of a close relative, among others. 

One of the reasons for which leave can be requested, which will be discussed in this article, is to undertake long-term professional training. This is a Luxembourg unpaid leave that allows the employee to return to the company after the leave without losing their acquired rights.

During this type of leave, the employment contract is suspended, and the duration of the leave is not taken into account when determining rights related to seniority, unless there are legal or contractual provisions to the contrary. Upon their return, the worker must be able to regain their job and all the benefits acquired before the start of the leave or, if this is not possible, a similar job that corresponds to their qualifications and with at least equivalent remuneration and the same benefits acquired.

Le congé sans solde pour formation au Luxembourg

Tout le monde sait généralement ce qu'est un congé payé, à savoir les 26 jours ouvrables par an qui s'accumulent au fur et à mesure que le temps de travail s'accumule et auxquels les salariés ont droit sous forme de jours de congé. Cependant, tout le monde ne sait pas qu'il est également possible de demander un congé pour d'autres raisons, telles que la force majeure ou des circonstances personnelles exceptionnelles, notamment un mariage ou le décès d'un proche, entre autres. 

L'une des raisons pour lesquelles un congé peut être demandé, qui sera abordée dans cet article, est de suivre une formation professionnelle de longue durée. Il s'agit d'un congé sans solde luxembourgeois qui permet au salarié de réintégrer son entreprise après le congé sans perdre ses droits acquis.

Pendant ce type de congé, le contrat de travail est suspendu et la durée du congé n'est pas prise en compte pour déterminer les droits liés à l'ancienneté, sauf disposition légale ou contractuelle contraire. Procédure de demande

Une fois que le salarié s'est assuré qu'il remplit toutes les conditions requises, il peut adresser une demande à l'employeur par courrier recommandé ou par lettre remise en mains propres, dans les deux cas avec accusé de réception et en respectant un préavis de deux mois pour les congés d'une durée inférieure à trois mois ou de quatre mois pour les congés d'une durée supérieure ou égale à trois mois.

La demande doit préciser le type de formation à suivre, la durée de la formation, l'organisme de formation, la ou les périodes de congé demandées et une déclaration indiquant que l'absence de réponse de l'employeur dans un délai de 30 jours équivaut à l'acceptation de la demande.

Une fois la demande reçue, l'employeur doit répondre par écrit dans un délai de 30 jours avec accusé de réception et dispose de trois options de réponse :

Une fois que l'employeur a accepté la demande de congé sans solde, ni l'employeur ni le salarié ne peuvent revenir sur leur décision, sauf en cas de force majeure et sous certaines conditions. What is subscription tax — and who has to pay?

In Luxembourg, investment funds pay something called the subscription tax — or “taxe d’abonnement.” It’s not charged to individual investors, but directly to the fund itself.

It’s calculated based on the fund’s net asset value (NAV) and must be paid quarterly. The authority in charge: Luxembourg’s Administration de l'enregistrement, des domaines et de la TVA (AED).

There are several tax rates, depending on the structure of the fund.

Funds aimed at pension schemes are fully exempt. RAIFs structured as limited partnerships (without legal personality) are also treated like SIFs — and benefit from the reduced rate.

How it’s calculated (with example)

The tax is calculated on the average net assets during a quarter. The formula looks like this:

NAV × Rate × 0.25 = Quarterly Tax

A UCITS fund with €200M average NAV per quarter, taxed at 0.05%, pays:€200,000,000 × 0.0005 × 0.25 = €25,000 per quarter
That’s €100,000 per year, fixed regardless of returns.

The fund files its return electronically via the eCDF platform and pays no later than the 20th day after the end of the quarter.

Who can apply for exemptions or lower rates?

How does subscription tax differ from other Luxembourg taxes?

Unlike most taxes, which are profit- or transaction-based, the subscription tax is based solely on the fund’s NAV. It’s more of a “maintenance cost” for operating an investment vehicle in Luxembourg.

It doesn't depend on profits. Even if your fund makes no returns, you’ll still owe the tax. That makes it predictable — helpful for planning — but also less forgiving for smaller or underperforming funds.

Filing and payment: how it works

Filing is fully digital. All reports must go through eCDF — Luxembourg’s secure tax portal, which is the country’s standard interface for all corporate tax filings. Fund administrators must be registered and authorised to access this platform. Most reporting is managed by professional firms or designated agents who are familiar with eCDF workflows.

Payments go to the Administration des contributions directes (ACD) via bank transfer.
