L'une des principales particularités de cette nouvelle convention est qu'elle adhère au modèle internationalement reconnu de l'OCDE. Parmi les points clés de cette convention figurent l'inclusion de changements dans les taux de retenue à la source pour les dividendes et les redevances et l'introduction d'une clause pour les sociétés riches en biens immobiliers qui impose les plus-values sur les actions provenant de biens immobiliers situés dans un État contractant.

En outre, la nouvelle convention prévoit une procédure amiable et une procédure d'arbitrage pour éviter la double imposition et la double non-imposition. Les sociétés luxembourgeoises exerçant des activités « actives » au sens des règles allemandes sur les CFC sont exonérées de l'impôt allemand sur les dividendes et dans tous les autres cas. En outre, en vertu de cette nouvelle convention, les taux de retenue à la source sur les dividendes sont ramenés à 5 % pour les participations de 10 % ou plus, tandis que les taux de retenue à la source sur les intérêts et les redevances restent inchangés.

CDI entre le Luxembourg et la Belgique

La convention de double imposition entre le Luxembourg et la Belgique a été initialement signée en 1970, mais elle a subi plusieurs modifications depuis lors. La version la plus récente de la convention a été signée le 17 septembre 2014 et est entrée en vigueur le 1er janvier 2015. The Luxembourg impatriate tax regime is a tax regulation, specifically developed and implemented for impatriate employees, which allows employers to exempt tax of certain parts of remuneration in connection to impatriation.

Impatriation&nbsp;means the facilitation of employees hired while residing abroad to come work to a new country, in this case, Luxembourg. Impatriate employees are also considered expats of course, with the difference that they relocate precisely because they accept a job offer in their new country, while residents in their previous one. The future of the Luxembourg impatriate tax regime

This draft law was proposed for implementation in order to improve Luxembourg's attractiveness as a workplace and promote the creation of high-skilled positions. There will be some expected tax revenue loss due to these new measures, but it shall be balanced later on as calculated by governmental, financial experts. Those measures are still subject to the approval of Parliament and the Council of State, and are expected to be in effect within 2025.

As of July 15th 2024, the tax scheme is available for eligible employees for 8 years instead of the previous 5-year tax exemption for expats working in Luxembourg. The regime was significantly improved, not only by expanding its validity period, but in other income eligibility percentage factors.

This tax regime does not apply to Luxembourgish citizens or residents, however if you have a different citizenship but you have lived in Luxembourg for a while, it crucially depends on when. For someone to be eligible for this tax scheme, they would need to have not lived -therefore declared income tax- in Luxembourg for at least the past 5 years. Before that, it does not really count, so you would still be eligible.

Ce projet de loi a été proposé pour être mis en œuvre afin d'améliorer l'attractivité du Luxembourg en tant que lieu de travail et de promouvoir la création de postes hautement qualifiés.
